Introduction, Agreement, and Definitions
These Terms of Service (the "Terms") are a binding agreement between you and Robert Spellinger LLC, a Utah limited liability company ("Spellinger," "we," "us," or "our"). These Terms govern your access to and use of spellinger.com and any pages, accounts, members areas, digital publications, subscription services, shops, features, content, and services made available through that domain (collectively, the "Services").
By accessing or using the Services, creating an account, or purchasing a subscription or product, you agree to these Terms. If you do not agree, do not use the Services. When a purchase screen, subscription disclosure, product page, Shipping and Returns Policy, Privacy Policy, or other posted policy supplies terms specific to a transaction or feature, those additional terms also apply. If there is a direct conflict, the more specific transaction or feature terms control for that transaction or feature.
"Mature Content" means material made available only to adults that may include nudity, adult themes, relationship or power-exchange themes, or discussion of adult products. Spellinger does not intend Mature Content to depict explicit or simulated sexual conduct.
Adult Eligibility and Mature Content
Spellinger is created for an adult audience. General editorial and shopping pages may be viewed without age verification. You must be at least 18 years old—or the age of majority in your jurisdiction, if higher—to create an account, purchase a subscription or age-restricted product, or access content designated as Mature Content. Certain products or services may require a higher minimum age under applicable law. We may use reasonable age-assurance measures for restricted products, services, and content.
Mature Content is intended for private, personal viewing by eligible adults. You are responsible for using the Services in a manner appropriate to your surroundings and for preventing access by minors or unauthorized persons.
Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. It is incorporated into these Terms by reference. Any third-party age-verification service may also provide a privacy notice governing information it collects directly. We do not intend to receive or retain copies of identity documents unless we expressly disclose otherwise and applicable law permits it.
Accounts and Account Security
You must provide accurate, current, and complete information when creating or maintaining an account. You may not impersonate another person, create an account for a minor, use false contact information, or create an account after we have terminated your access without our written permission.
You are responsible for safeguarding your login credentials and for activity you authorize through your account. Paid memberships are licensed for use by one individual and may not be shared, transferred, resold, or made available to a household, group, or business unless a plan expressly permits it. Notify us promptly at service@spellinger.com if you believe your account or payment credentials have been compromised. We may require reasonable steps to verify account ownership before restoring access or changing account information.
Subscriptions and Paid Memberships
Subscription Plans
Spellinger may offer digital memberships, print magazine subscriptions, or bundles containing both. Digital membership generally provides access to the members area and designated premium content during an active subscription. Print subscriptions provide the number or sequence of issues identified at checkout. Spellinger currently plans to publish one print issue approximately every three months, but publication and delivery dates are estimates unless expressly guaranteed.
Spellinger currently expects to offer quarterly and annual subscription plans. A quarterly plan is billed in advance once every three months and covers the benefits or print issue identified for that three-month period. An annual plan is billed in advance once per year and covers the benefits or print issues identified for that twelve-month period. The plan name, included benefits, initial price, billing cadence, and renewal terms presented at checkout are part of your agreement. If Spellinger later offers a monthly plan, its price, benefits, billing cadence, and renewal terms will be disclosed at checkout before purchase.
Automatic Renewal and Authorization
UNLESS YOU CANCEL, A QUARTERLY SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR ANOTHER THREE-MONTH PERIOD AND AN ANNUAL SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR ANOTHER TWELVE-MONTH PERIOD. YOU AUTHORIZE US AND OUR PAYMENT PROCESSOR TO CHARGE THE THEN-APPLICABLE SUBSCRIPTION PRICE AND REQUIRED TAXES TO YOUR PAYMENT METHOD AT EACH RENEWAL. Renewal disclosures shown at checkout form part of these Terms. We will provide renewal or trial-expiration notices when required by applicable law.
Cancellation
You may cancel automatic renewal through the subscription-management controls in your account or by contacting service@spellinger.com. Cancellation must be completed before the next charge is processed to avoid that charge. Unless applicable law or the checkout disclosure provides otherwise, cancellation takes effect at the end of the current paid period: digital access continues until then, and any print issues included in the already-paid subscription period remain scheduled for fulfillment.
Subscription Refunds
Subscription fees are nonrefundable and we do not provide prorated refunds or credits for unused portions of a subscription, except when required by law or when we expressly agree otherwise. If we discontinue a paid service before the end of a prepaid period and do not provide a reasonably comparable substitute, we may provide a prorated refund or credit at our discretion, subject to applicable law.
Price Changes and Failed Payments
We may change subscription prices prospectively. We will give advance notice required by law before a changed price applies to a renewal. If a charge is declined, we may retry the payment method, request an updated method, suspend benefits, or cancel the subscription. You remain responsible for authorized charges incurred before cancellation.
Orders and Shop Terms
United States Sales; Product Information
The shop initially accepts orders for delivery within the United States only. Product descriptions, photographs, dimensions, colors, materials, packaging, availability, and estimated fulfillment times are provided as accurately as reasonably possible, but minor variations may occur. Handmade, limited-run, print-on-demand, and supplier-fulfilled products may vary from representative images. You are responsible for confirming that a product is lawful to purchase, possess, receive, and use in your location.
Orders, Pricing, and Availability
Your order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons, including unavailability, suspected fraud, legal restrictions, shipping limitations, or a material pricing or description error. If we cancel after payment, we will refund the amount charged for the cancelled item and associated unearned shipping or taxes. Prices and promotions may change without notice before an order is accepted. We will not substitute a materially different product without your consent.
Payments, Taxes, and Currency
Prices are stated in U.S. dollars unless clearly indicated otherwise. You authorize us and our payment processors to charge the payment method you provide for the order total, shipping, taxes, and other amounts disclosed before purchase. Payment processors may collect and process payment information under their own terms and privacy notices. Spellinger remains responsible for its own handling of information and does not disclaim obligations that applicable law imposes on us. You are responsible for sales, use, excise, or similar taxes that we are required or permitted to collect.
Fulfillment, Shipping, and Delay
Products may be fulfilled from our inventory, by a dropship supplier, or through a print-on-demand provider. Shipping dates are estimates unless expressly guaranteed. If we cannot ship within the promised time, or within the period required by applicable law when no time is stated, we will provide any required delay notice and cancellation or refund option. Separate packages may arrive at different times. Risk of loss and title transfer only as provided by applicable law and the shipping terms shown for the order.
Returns, Defects, and Mature Products
Our posted Shipping and Returns Policy forms part of these Terms. Because of hygiene, health, safety, and tamper concerns, intimate or adult products are final sale and may not be returned or exchanged once shipped, except when the product arrives defective, damaged, materially different from what was ordered, or applicable law requires a remedy. To request a remedy, contact service@spellinger.com within the period stated in the Shipping and Returns Policy and preserve the product, packaging, order information, and reasonable evidence of the problem. Do not return a product without authorization.
Books, magazines, print-on-demand goods, personalized goods, clearance goods, digital content, and opened or used products may have separate return restrictions disclosed before purchase. Nothing in these Terms limits nonwaivable rights for defective products, inaccurate shipments, recalls, or other remedies required by law.
Product Safety and Proper Use
Read and follow all manufacturer instructions, warnings, materials information, cleaning directions, storage requirements, and age restrictions. Inspect products before use and stop using any product that appears damaged, deteriorated, contaminated, or unsafe. Products are not medical devices or substitutes for professional advice unless expressly identified as such. If you have a medical condition, allergy, injury, implanted device, pregnancy, medication concern, or uncertainty about safe use, consult an appropriate licensed professional. Misuse, modification, or use contrary to instructions is prohibited.
Editorial and Mature Content
The Services may contain journalism, opinion, fiction, art, photography, interviews, product commentary, Mature Content, and other editorial material. Views expressed by contributors or interview subjects are their own and do not necessarily reflect Spellinger's views. Editorial and Mature Content is provided for informational, artistic, or entertainment purposes and is not medical, legal, financial, psychological, or professional advice.
Access to Mature Content does not grant permission to copy, record, capture, reproduce, identify, contact, harass, threaten, dox, impersonate, exploit, or redistribute any depicted person. If you believe content depicts you without authorization, violates consent, infringes rights, or should be removed for another urgent reason, contact service@spellinger.com with the URL and sufficient information to identify the material.
Intellectual Property and Limited License
The Services and their selection, arrangement, design, software, text, graphics, photographs, illustrations, audio, video, trademarks, logos, product names, and other content are owned by or licensed to Spellinger and are protected by intellectual-property and other laws. References to third-party works, products, or marks do not transfer ownership to Spellinger and remain subject to their respective owners' rights.
Subject to these Terms, Spellinger grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Services and lawfully purchased digital content for your own private, noncommercial use. No ownership interest is transferred. Except where the Services expressly provide a download, you may not reproduce, download, record, scrape, crawl, index, train an automated system on, modify, create derivative works from, publicly display, publicly perform, sell, license, distribute, transmit, defeat access controls for, or commercially exploit the Services or content without written permission. Ordinary browser caching and accessibility technology used to access the Services as intended are permitted.
No Public User Content; Acceptable Use
The Services do not provide public comments, product reviews, public profiles, forums, or user-upload features. You may communicate privately with Spellinger only through the account, order-support, customer-service, or other contact methods we expressly provide. Editorial pitches, photography, model content, and commissioned work are accepted only through a designated contributor process and are governed by separate written agreements, releases, consent documentation, and any required age, identity, and rights records.
You may not misuse the Services, including by engaging in unlawful activity; impersonating another person; infringing intellectual-property, privacy, publicity, or other rights; attempting to transmit malware, phishing, spam, threats, harassment, or nonconsensual intimate material; collecting personal information without lawful authority; sharing paid credentials; circumventing access, payment, security, geographic, or age-verification controls; scraping or reverse engineering the Services; or interfering with their operation.
Copyright Complaints
If you believe material on the Services infringes your copyright, send a written notice to the Copyright Contact identified below. A notice should include: identification of the copyrighted work; identification and location of the allegedly infringing material; your name and contact information; a statement of your good-faith belief that the use is not authorized by the copyright owner, its agent, or law; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner; and your physical or electronic signature.

We may investigate and remove or disable access to material in response to a valid notice. Knowingly making a material misrepresentation in a copyright notice may create liability.
Third-Party Services and Links
The Services may link to or interoperate with payment processors, age-verification services, fulfillment providers, social networks, advertisers, makers, retailers, or other third parties. Their products, content, availability, data practices, and terms are controlled by them. A link or reference does not necessarily constitute endorsement. Spellinger is responsible for its own conduct but is not responsible for independent third-party services outside our control. Review the third party's terms and privacy notices before using its service.
Electronic Communications
You consent to receive transactional and legal communications electronically, including account notices, receipts, subscription disclosures, renewal reminders, shipping updates, security notices, and changes to these Terms. Electronic communications satisfy legal writing requirements to the extent permitted by law. Keep your email address current. Marketing communications are governed by the choices and unsubscribe controls presented to you; agreeing to these Terms does not by itself require you to accept optional marketing email.
Suspension and Termination
You may stop using the Services at any time and may request account deletion as described in the Privacy Policy, subject to transaction, security, legal, and record-retention requirements. Deleting an account does not automatically cancel an active subscription unless the deletion process expressly confirms cancellation.
We may suspend or terminate access, refuse service, or cancel an order when reasonably necessary to address fraud, chargebacks, legal restrictions, security risks, misuse, nonpayment, threats to others, or a material violation of these Terms. When practical and lawful, we will provide notice and a reasonable opportunity to cure. Provisions that by their nature should survive termination—including payment obligations, intellectual-property protections, disclaimers, liability limitations, indemnity, dispute provisions, and record-retention rights—will survive.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." SPELLINGER DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR A PARTICULAR PURPOSE.
This disclaimer does not apply to express product warranties stated in writing, manufacturer warranties passed through to you, or warranties and remedies that applicable law does not permit us to exclude. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPELLINGER AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPELLINGER'S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SPELLINGER FOR THE SERVICE OR PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, certain personal injuries, defective products, or violation of nonwaivable consumer rights where applicable. The limitations apply only to the extent permitted in your jurisdiction.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Spellinger and its members, managers, employees, contractors, and agents from third-party claims, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the Services or your material breach of these Terms. You are not required to indemnify a party for its own negligence, willful misconduct, or violation of law. We will provide reasonable notice of a covered claim and may control its defense, while allowing your reasonable participation.
Dispute Resolution; Utah Law
Informal Resolution
Before filing a lawsuit, you and Spellinger agree to make a good-faith effort to resolve the dispute for at least 30 days. A notice to Spellinger must be sent to service@spellinger.com and must describe the claimant, relevant account or order, facts, requested relief, and supporting information. This requirement does not prevent either party from seeking urgent injunctive relief, filing an eligible small-claims action, preserving a claim before a limitations period expires, or using a legally required regulatory or administrative process.
Governing Law and Courts
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except that the laws of your home jurisdiction may apply to nonwaivable consumer rights. Subject to those rights, any court proceeding arising from these Terms or the Services must be brought in a state or federal court with jurisdiction in Salt Lake County, Utah, and each party consents to personal jurisdiction and venue there. Either party may bring an eligible individual claim in small claims court. These Terms do not require arbitration unless you and Spellinger separately agree to arbitrate a particular dispute.
Time Limit for Claims
To the extent permitted by law, any claim arising from or related to the Services or these Terms must be filed within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim. This contractual period does not shorten a limitations period that applicable law does not permit the parties to shorten.
Changes to the Services and These Terms
We may modify the Services and may update these Terms from time to time. Changes apply prospectively from the stated effective date. For material changes, we will provide notice reasonably appropriate to the change, such as email, an account notice, or a conspicuous site notice. If applicable law requires affirmative consent, we will request it. Continued use after the effective date constitutes acceptance only to the extent permitted by law. Changes to subscription price, renewal, or other material transaction terms will follow the disclosures and notice required by applicable law.
General Provisions
These Terms, the Privacy Policy, the purchase or subscription disclosures accepted by you, and any incorporated feature-specific policy constitute the agreement between you and Spellinger concerning the Services. They do not replace a separately signed contributor, model, vendor, wholesale, sponsorship, or licensing agreement.
If a provision is found unlawful or unenforceable, it will be enforced to the greatest extent permitted and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms or transfer an account without our written consent. We may assign these Terms in connection with a merger, financing, reorganization, sale of assets, or transfer of the Services, subject to applicable law. Neither party is liable for delay caused by events beyond its reasonable control, except that this does not excuse payment obligations already incurred or remedies required by consumer law.
Section headings are for convenience only. "Including" means "including without limitation." No agency, partnership, joint venture, employment, or fiduciary relationship is created by these Terms. Nothing in these Terms waives a right or remedy that applicable law makes nonwaivable.
